OF THE FEDERAL DEMOCRATIC REPUBLIC OF ETHIOPIA 10 Year No. 15 ADDIS ABARA 13th January , 2004 CONTENTS Proclamation No. 380/2004 Reorganization of the Executive Organs of the Federal Democratic Republic of Ethiopia / Amendment / Proclamation Page 2514 PROCLAMATION NO . 380/2004 . A PROCLAMATION TO AMEND THE REORGANIZATION OF THE EXECUTIVE ORGANS OF THE FEDERAL DEMOCRATIC REPUBLIC OF ETHIOPIA PROCLAMATION WHEREAS , it has become necessary to amend the Executive Organs of Federal Democratic Republic of Ethiopia ; NOW , THEREFORE , in accordance with Article 9 & 18 / 55 ( 1 ) of the Constitution of the Federal Democratic Republic of Ethiopia , it is hereby proclaimed as follows : 1. Short Title This Proclamation be cited " Reorganization of the Executive Organs of the Federal Democratic Republic of Ethiopia ( Amendment ) Proclamation No. 380/2004 . " 2. Amendment The Reorganization of the Executive Organs of the Federal Democratic Republic of Ethiopia Proclamation No. 256/2001 is hereby amended as follows : Unit Price The African Law Archive 1 / Sub - Articles ( 3 ) and ( 7 ) of Article 4 of the Proclamation are deleted and replaced by the following new Sub - Article ( 3 ) : “ 3 / Ministry of Agriculture and Rural Development ; " 21 Sub - Article ( 8 ) - ( 18 ) of Article 4 of the Proclamation are renumbered as Sub - Articles ( 7 ( 17 ) respectively , 3 / Sub - Article 2 ( c ) and ( h ) of Article 5 of the Proclamation are deleted and Sub - Articles 2 ( d ) ( g ) are renumbered as Sub - Articles 2 ( c ) - ( f ) respectively ; 4 / Sub - Article ( 3 ) of Article 5 of the Proclamation is deleted and replaced by the following new Sub Article ( 3 ) : “ 3 / The following executive organs and public enterprises shall be accountable to the Ministry Agriculture Rural Development : a ) the Disaster Prevention and Preparedness Commission ; b ) the Cooperatives ' Commission ; c ) the Ethiopian Agricultural Research Organization ; d ) Institute of Biodiversity Conservation and Research ; e ) the Ethiopian Social Rehabilitation and Development Fund ; f ) the Ethiopian Rural Energy Development and Promotion Center ; g ) the National Veterinary Institute ; h ) the Ethiopian Seeds Enterprise ; i ) the Ethiopian Grain Trade Enterprise . ” 51 Article 8 of the Proclamation is deleted and replaced by the following new Article 8 : “ 8. The Ministry of Agriculture and Rural Development 1 / The Ministry of Agriculture and Rural Development shall have the powers and duties to : a ) promote the expansion of rapid and sustainable agricultural and rural development ; The African Law Archive b ) prepare land - use and administration policy as well as draft laws on the conservation and utilization of forest and wildlife resources ; follow up and coordinate their implementation ; c ) direct and coordinate the implement ation Security d ) encourage and assist the provision of agricultural extension services to peasants and pastoralists ; e ) encourage and support the expansion of water harvesting and small scale irrigation schemes ; f ) in cooperation with the concerned organs , create conducive conditions expansion rural development infrastructure ; g ) in cooperation with the concerned organs , facilitate the provision of credit facilities to peasants and pastoralists ; h ) provide comprehensive support to private investors engaged in the agricultural sector ; i ) monitor events affecting agricultural development and set up an early warning system ; j ) conduct quarantine controls plants , seeds , animals and animal products brought into or taken out of the country ; k ) take the necessary measures prevent the outbreak of animal and plant disease and migratory pests ; 1 ) with a view to enhancing market - led agricultural development creating efficient agricultural inputs and products marketing system The African Law Archive ( 1 ) closely monitor market signals , in particular those of inter- national markets , and provide peasants , pastoralists and investors with comprehensive , up - to - date and accurate information to enable them identify those agricultural products which they can produce at competitive price and quality ; ( 2 ) conduct demand forecast studies for major agricultural products and inputs and disseminate the results thereof to the concerned parties ; ( 3 ) issue guidelines and procedures for agricultural input evaluation and release , and monitor their implementation ; ( 4 ) ensure the distribution of high quality agricultural inputs to users ; ( 5 ) make the necessary support in capacity building in production , supply , distribution marketing of agricultural inputs ; ( 6 ) devise ways and means of promoting the domestic and export agricultural products market ; ( 7 ) in cooperation with the concerned organs , promote establishment and expansion of agricultural products market centers ; ( 8 ) cooperate with the Quality and Standard Authority of Ethiopia in standardization of agricultural products ; ( 9 ) set criteria to be fulfilled by traders engaged in the prod uction , supply and distribution of agricultural inputs and processing , grading and export of agricultural products ; The African Law Archive ( 10 ) without prejudice to the relevant laws , issue import and export permit for agricultural inputs ; ( 11 ) promote the expansion of out growers scheme to secure reliable supply and market for agricultural products ; ( 12 ) undertake studies and submit recommendations on measures to be taken by the Government to stabilize price for agricultural inputs and products ; m ) in cooperation with the concerned organs , identify bottlenecks agricultural and rural development and contribute towards their solution ; n ) establish and direct training establish ments that may assist the enhancement of agriculture and the improvement or rural technology ; o ) coordinate and assist regional govern in the implementation of ments p ) direct and coordinate the executive organs referred to in Sub - Article 3 ( a ) ( f ) of Article 5 of this Proclamation ; review organizational structures as well as work programmes and budgets of the executive organs and approve their submission to the appropriate government organs ; q ) supervise the enterprises referred to in Sub - Article 3 ( g ) - ( i ) of Article 5 of this Proclamation in accordance with the provisions of the Public Enterprises Proclamation No. 25/1992 ; and ensure that they operate as development catalysts ; The African Law Archive r ) perform such other activities necessary enhance expansion agricultural and rural development . 2 / The powers and duties given to the Ministry of Agriculture and the Ministry of Rural Development by the provisions of other laws , currently in force , the powers and duties which were given to the Coffee and Tea Authority by Article 5 ( 6 ) of Proclamation No. 116/1995 with regard to the issuance of coffee export authorization certificate , the powers and duties given to the National Agricultural Input Authority by the Fertilizer Manufacturing and Trade Proclamation No. 137/1998 , the Seed Proclamation No. 206/2000 and Article 12 of Proclamation No. 288/2002 and the powers and duties vested in the Ministry of Trade and Industry under the Proclamation to Provide for a Warehouse Receipts System No 372/2003 with respect to agricultural products are hereby given to the Ministry of Agriculture and Rural Development . 3 / For the purpose of application of Sub Article 1 ( 1 ) of this Article : a ) “ agricultural input ” means plant seed , fertilizer , pesticide , improved small · agricultural implements , modern bee hives , improved variety of livestock breeds , livestock feed and small scale irrigation water harvesting materials available for market to improve production and productivity of the agricultural sector and include other inputs designated as such by the Ministry ; b ) " plant seeds ” means a mature ovule or the seed , bulbs , tubers , cuttings or any other plant material used for the propagation of plants ; c ) “ fertilizer ” means any natural or industrial product of organic or inorganic origin that contain one or more plant nutrient which could help to maintain and / or improve soil fertility ; The African Law Archive means d ) “ pesticide ” any substance , chemical , compound or mixture thereof or a living organism intended for use as an agricultural input to prevent or control pests ; e ) “ pest ” means a free , parasitic or saprophytic which cause a decline in yield and quality during production , processing , storage , transport marketing of agricultural products and commodities ; f ) “ agricultural products ” include crops , vegetable livestock , livestock products and by - products and forest products ; g ) “ crops ” include cereals , pulses , oil seeds , coffee , tea , cotton , spices and other types of grain and fiber crops ; include h ) “ vegetable vegetable , fruits and flowers ; i ) “ livestock ” means cattle , sheep , goat , camel , poultry , pig , bee , fish and include other products designated as such by the Ministry ; j ) “ livestock product ” means meat , milk , butter , cheese , egg , honey , wax , sheep hair , civet musk and includes other products designated as such by the Ministry ; means k ) “ livestock by - products ” anything of value produced from the slaughter of animal such as hide , skin , horn , hoof , meat and bone meal and include other by- products designated as such by the Ministry ; 6 / Article 12 of the Proclamation is deleted and Article 13-27 are renumbered as Article12-26 respectively . The African Law Archive 7 / Sub - Article ( 1 ) of Article 24 ( the former Article 25 ) of the Proclamation is deleted and replaced by the following new Sub - Article ( 1 ) : “ 1 / Articles 6 , 9 and 12 of Proclamation No. 4/1995 , the Coffee and Tea Authority Establishment Proclamation No. 116/1995 , Livestock Marketing Authority Establishment Proclamation No. 117/1998 ( as amended by Proclamation No. 198/2000 ) , the National Agricultural Input Authority Establishment Proclamation No. 288/2002 and Sub - Article ( 2 ) of Article 2 Institute Biodiversity Conservation and Research Establishment ( Amendment ) Proclamation No.167 / 1999 are hereby repealed . ” 8 / The following new Sub - Article ( 7 ) is added under Article 25 ( the former Article 26 ) of the Proclamation : “ 7 / The rights and obligations of the Ministry of Agriculture , the Ministry of Rural Development , the Coffee Authority established under Proclamation No. 116/1995 , the Livestock Marketing Authority established under Proclamation amended Proclamation No. 198/2000 ) , the National Agricultural Input Authority establishment under Proclamation No. 288/2002 as well Wildlife Conservation Development Authority re - established under Article 2 ( 2 ) of the Institute of Biodiversity Conservation and Research Establishment ( Amendment ) Proclamation No.167 / 1999 ( known as the Wildlife . Conservation Development Organization ) are hereby transferred to the Ministry of Agriculture and Rural Development . " The African Law Archive 3.
