In accordance with Article 6 of the Definition of Powers of the Provisional Military Administration Council and its Chairman Proclamation No. 2/1974, it is hereby proclaimed as follows:

Short Title
This Proclamation may be cited as the " Special Courts Martial Establishment and Special Criminal Procedure Code Proclamations Amendment Proclamation No. 38/1975. ”
Amendment
(1) Article 5 of the Special Criminal Procedure Code Proclamation No. 9/1974, as amended by Proclama tion No. 21/1975 is hereby further amended as follows:
(a) in sub - article 2 (a) Article " 12 (1) " is added before Article “ 14 (2) ” ;
(b) in sub - article 2 (b) Articles “ 35 ” and “ 41 ” are added after Articles “ 34 ” and “ 39 ”, respectively ;
(c) the phrase “ or by the decision of the Prosecutor of the Special Courts - Martial " is added after the phrase " upon order by the Government " appearing in the proviso to sub - article 2 ;
