OF THE FEDERAL DEMOCRATIC REPUBLIC OF ETHIOPIA 8th Year No. 1 ADDIS ABABA - 84 October , 2001 CONTENTS Proclamation No. 255/2001 Administration of the President of the Federal Democratic Republic of Ethiopia Proclamation Page 1626 PROCLAMATION No. 255/2001 A PROCLAMATION TO PROVIDE FOR THE ADMINISTRATION OF THE PRESIDENT WHEREAS , it has become necessary to specify the Constitution of the Federal Democratic Republic of Ethiopia WHEREAS , it has become necessary to regulate and the Republic having taken his service into consideration ; NOW , THEREFORE , in accordance with Article 55 ( 1 ) of the Constitution , it is hereby proclaimed as follows : PART ONE General 1. Short Title This proclamation may be cited as the " Administration of the President of the Federal Democratic Republic of Ethiopia Proclamation No. 255/2001 . " 2. Definition 1 / " president " means the Person designated in accor dance with sub - Article ( 2 ) of Article 70 of the Constitution of the Federal Democratic Republic of Ethiopia ; Unit Pricei-canLawArchive.com * The African Law Archive * * * www.African Negarit.GP.O.Box 80,001 2 / “ Ex - President ” means a person who had been designated in accordance with sub - Article ( 2 ) of Article 70 of the Constitution of the Federal Democratic Republic of Ethiopia and terminated his presidency due to illness , death , accomplishment of his term of office or any other reason ; 31 " Office of the President ' ' means the Office es tablished by Proclamation No. 131/1998 in order to serve the presidential institution of the Federal Democratic Republic of Ethiopia .; PART TWO Institution of the President 3. The President shall be elected for a term of office of six years which shall terminate at the first joint session , of the House of the Federation and the House of Peoples ' Representatives , to be held at the second year of their election . 4. The President shall , during his Presidency , have a monthly salary and other benefits to be approved by the House of Peoples ' Representatives ; 5. The Office of the President shall prepare a proposal of any expenditure necessary for the office to be disbursed on the basis of its annual budget to be approved by the House of Peoples ' Representatives . 6. A President who accepts his candidacy , in accordance with Articcle 70 ( 2 ) of the Constitution , shall be required to prove that he has no affiliation with any political party , in the country , and serve impartially ; 7. The President shall be obliged to keep himself aloof from any partisan political movement during or after his presidency . 8. Where the President , before the termination of his term of office , discontinues his service due to illness , death , resignation or due to his conviction , the House of Peoples ' Representatives and the House of the Federation shall , by an extra - ordinary joint session convened by the Speaker of either of the Houses or by the Speakers of both Houses jointly , designate an acting President . 9. The Acting President designated pursuant to Article 8 of this Proclamation shall hand over the presidency to the President elected in accordance with Article 3 of this Proclamation . PART THREE Ex - President 10. An Ex - President shall remain part of the presidential institution of the Federal Democratic Republic of Ethiopia . An Ex - President shall remain , through out his life time , loyal to the objectives of the Presidential institution . sibilities and duties : ( a ) to support and defend the Constitution of the Federal Democratic Republic of Ethiopia ; ( b ) to keep the secrecy of national affairs and infor mation , he has obtained in the course of his service as President ; ( c ) to refrain from any unethical practices which dishono the Presidential institution of the Republic ( d ) to ascertain that all his private businesses and activities are not inconsistent with the Principles and Provisions provided for in this Proclamation . 1 ) An Ex - President shall be entitled to the following rights and benefits : ( a ) a regular house of residence to be maintained The African Law Archive * - No. 1 8 October , 2001 – Page 1628 ( b ) a monthly maintenance allowance of birr 5,000.00 ( five thousand birt ) which may be improved , by the House of Peoples ' Representatives , having regard to the cost of living ; ( c ) to have the service of private security forces at his own disposal , and other servants for his house work , at the expense of the government ; ( d ) to obtain medical facilities , free of charge , for himself and his family ; ( e ) The monthly maintenance allowance of an Ex President , shall continue , upon his death , to be disbursed to his widow and to his descendents who have not attained majority . 2 ) Notwithstanding the Provisions of Sub - Article ( 1 ) of this Article , an Ex - President who has been removed by a legal action shall not enjoy the rights and benefits set forth in this Article . PART FOUR Termination of the Rights and Benefits of Ex - President 14. The rights and benefits of an Ex - President provided for in Article 13 of this proclamation may be terminated where : ( a ) he chooses to waive these rights , privileges and benefits and notifies , in writing , his decision to the House of Peoples ' Representatives ; ( b ) he fails to discharge his obligations and a joint decision has been given by the Speakers of the House of peoples ' Representatives and the House of the Federation or by an extra - ordinary joint session of the two Houses they convene . 15.
