OF THE FEDERAL DEMOCRATIC REPUBLIC OF ETHIOPIA . gth Year No. 2 ADDIS ABABA - 12h October , 2001 CONTENTS Proclamation No. 256/2001 Reorganization of the Executive Organs of the Federal Democratic Republic Ethiopia Proclamation Page 1629 PROCLAMATION No. 256/2001 A PROCLAMATION TO PROVIDE FOR THE REORGANIZATION OF THE EXECUTIVE ORGANS OF THE FEDERAL DEMOCRATIC REPUBLIC OF ETHIOPIA WHEREAS , the Organization of the preceding ex promptness of activities ; WHEREAS , the executive body is required to carry out the Schedule of its activities with due promptness ; WHEREAS , it is found necessary to reorganize the Executive Organs of the Federal Democratic Republic of Ethiopia ; NOW , THEREFORE , in accordance with Article 55 ( 1 ) of the Constitution of the Federal Democratic Republic of Ethiopia , it is hereby proclaimed as follows : PART ONE General This Proclamation may be cited as the " Reorganization of the Executive Organs of the Federal Democratic Republic of Ethiopia Proclamation No. 256/2001 ” 2. Definition In this Proclamation : 1 ) " Proclamation No.4 / 1995 " means the Definition of Powers and Duties of the Executive Organs of the Federal Democratic Republic of Ethiopia Proclamation No. 4/1995 ; 2 ) " Region " means a Region under Article 47 of the Constitution as a member of the Federal Democratic Republic of Ethiopia ; 3 ) “ Ministry ' includes the Office referred to in Article 4 ( 1 ) of this Proclamation . Members of the Council of Ministers 1 ) The Council of Ministers shall have the following members : ( a ) The Prime Minister ; ( b ) The Deputy Prime Minister ; ( c ) Ministers that head the Ministries specified under Article 4 hereunder ; ( d ) Other officials to be designated by the Prime Minister . 2 ) Where any Minister referred to in Sub Article ( 1 ) ( C ) of this Article is unable to attend the meetings of the Council , his deputy or , in case where there are more than one deputies , the deputy specifically delegated shall take part in the meetings of the Council as a substitute member . 3 ) A Deputy referred to in Sub Article ( 2 ) of this Article may have the rank of Minister , Minister of State or Vice Minister as may be appropriate . 4. Establishment of Ministries The following Ministries are hereby established : 1 ) Office for the Coordination of Capacity Building ; 2 ) Ministry of Trade and Industry ; 3 ) Ministry of Rural Development ; 4 ) Ministry of Development Infrastructure ; 5 ) Ministry of Finance and Economic Development ; 6 Ministry of Federal Affairs ; 7 ) Ministry of Agriculture ; 8 ) Ministry of Education ; 9 ) Ministry of Health ; 10 ) Ministry of Justice ; 11 ) Ministry of Revenues ; 12 ) Ministry of National Defence ; 13 ) Ministry of Foreign Affairs ; 14 ) Ministry of Information ; 15 ) Ministry of Water Resources ; 16 ) Ministry of Youth , Sports and Culture , 17 ) Ministry of Mines ; 18 ) Ministry of Labour and Social Affairs . 5. Accountability 1 ) The following executive organs shall be accountable to the Office for the Coordination of Capacity Building ፡ ( a ) Ministry of Education ; ( b ) Ethiopian Science and Technology Commis sion ; ( c ) Federal Civil Service Commission ; ( d ) Ethiopian Management Institute ; ( e ) Ethiopian Civil Service College ; ( f ) Justice and Legal System Research Institute . * * The African Law Archive 2 ) The following executive organs shall be accountable to the Ministry of Trade and Industry : ( a ) Ethiopian Investment Authority ; ( b ) Quality and Standards Authority of Ethiopia ; ( c ) Coffee and Tea Authority ; ( d ) Supervising Authority of Public Enterprises ; ( e ) Basic Metals and Engineering Industry Agency ; ( f ) Ethiopian Export Promotion Agency ; ( g ) Ethiopian Privatization Agency ; ( h ) Livestock Marketing Authority ; 3 ) The following executive organs shall be accountable to the Ministry of Rural Development : ( a ) Ministry of Agriculture ; ( b ) Disaster Prevention and Preparedness Com mission ; ( c ) Ethiopian Social Rehabilitation and Develop ment Fund ; ( d ) National Seed Industry Agency ; ( e ) National Fertilizer Industry Agency ; ( f ) Ethiopian Agricultural Research Organization ; ( g ) Institute of Biodiversity Conservation and Research ; ( h ) Ethiopian Rural Energy Development and 4 ) The following executive organs and enterprises shall be accountable to the Ministry of Development Infrastructure : ( a ) Ethiopian Roads Authority ; ( b ) Civil Aviation Authority ; ( c ) Road Transport Authority ; ( d ) Road Fund Office ; ( e ) National Petroleum Reserve Depots Adminis tration ; ( f ) Ethiopian Postal Service ; ( g ) Ethiopian Telecommunications Agency ; ( h ) Ethiopian Electricity Agency ; ( i ) Ethiopian Telecommunications Corporation ; ( ) Ethiopian Electric Power Corporation ; ( k ) Agency for the Administration of Rented Houses . 5. The following executive organs shall be accountable to the Ministry of Finance and Economic Develop ment : ( a ) Central Statistical Authority ; ( b ) Ethiopian Mapping Authority ; ( c ) National Office of Population ; ( d ) Office for the Sale of Government Owned Houses . 6 ) The following executive organs shall be accountable to the Ministry of Federal Affairs : ( a ) Federal Police Commission ; ( b ) Federal Prisons Administration ; ( c ) National Urban Planning Institute ; ( d ) Addis Ababa City Government ; 7 ) The Drug Administration and Control Authority shall be accountable to the Ministry of Health . 8 ) The following executive organs shall be accountable to the Ministry of Revenues : The African Law Archive WWW.Aft ( a ) Federal Inland Revenues Authority ; ( b ) Customs Authority ; ( c ) National Lottery Administration . 9 ) The following executive organs shall be accountable to the Ministry of Information : ( a ) Ethiopian Broadcasting Agency ; ( b ) Mass Media Training Institute . 10 ) The following executive organs shall be accountable to the Ministry of Sports , Youth and Culture : ( a ) Authority for Research and Conservation of Cultural Heritage ; ( b ) National Archives and Library Agency ; ( c ) Ethiopian Conference Centre ; ( d ) Ethiopian National Theater . 11 ) The Ethiopian Geological Survey shall be accoun table to the Ministry of Mines . PART THREE Powers and Duties of Ministries The Office for the Coordination of Capacity Building shall have the powers and duties to : 1 ) initiate national capacity building policies , prepare programmes and budget and , upon approval , im plement same ; 2 ) ensure that the necessary capacity is created for the national capacity building ; 3 ) supervise and coordinate the executive organs referred to in Article 5 ( 1 ) of this Proclamation , 4 ) support regions in promoting capacity building activities ; 5 ) Perform other activities necessary for the enhan cement of capacity building . 7. Ministry of Trade and Industry 1 ) The Ministry of Trade and Industry shall have the powers and duties given to it by Article 14 of Proclamation No. 4/1995 and by other laws . 2 ) Without prejudice to Sub Article ( 1 ) of this Article , the Ministry of Trade and Industry shall supervise and coordinate the executive organs referred to in Article 5 ( 2 ) of this Proclamation . 8. Ministry of Rural Development The Ministry of Rural Development shall have the powers and duties to : i ) Initiate rural development policies , prepare programmes and budget and upon approval , im plement same ; 2 ) ensure that conducive conditions are created for the development , processing and supply of inputs neces sary for rural development . 3 ) monitor the Food Security Programme ; 4 ) supervise and coordinate the executive organs referred to in Article 5 ( 3 ) of this Proclamation ; 5 ) support Regions in expanding rural development ; 6 ) perform other activities necessary for the expansion of rural development . Ministry of Development Infrastructure 1 ) The powers and duties given to the Ministry of Transport and Communications , the Ministry of Mines and Energy with respect to Energy and the Ministry of Works and Urban Development by Articles 18 and 15 and Sub Articles ( 1 ) - ( 6 ) and ( 12 ) of Article 16 of Proclamation No.4 / 1995 and other laws respectively are hereby given to the Ministry of Development Infrastructure . The African Law Archive 2 ) Without prejudice to Sub Article ( 1 ) of this Article , the Ministry of Development Infrastructure shall : ( a ) supervise and coordinate the executive organs and enterprises referred to in Article 5 ( 4 ) of this Proclamation ; ( b ) follow up the activities of the Ethio - Djibouti Railway in accordance with the Agreements concluded between the two countries . 10. Ministry of Finance and Economic Development 1 ) The powers and duties given to the Ministry of Economic Development and Cooperation and the Ministry of Finance by Articles 13 and 19 of Proclamation No. 4/1995 and other laws respec tively are hereby given to the Ministry of Finance and Economic Development . 2 ) Without prejudice to Sub Article ( 1 ) of this Article , the Ministry of Finance and Economic Develop ment shall supervise and coordinate the executive organs referred to in Article 5 ( 5 ) of this Proclamation . 11. Ministry of Federal Affairs 1 ) The Ministry of Federal Affairs shall have the powers and duties to : ( a ) In cooperation with the Regions , ensure that public peace and order is maintained ; ( b ) without prejudice to the provisions of Articles 48 and 62 ( 6 ) of the Constitution of the Federal Democratic Republic of derstandings arising between Regions ; ( c ) give assistance to the Regions with par ticular emphasis to the less developed ones ; ( d ) supervise and coordiate the executive or gans referred to in Article 5 ( 6 ) of this Proclamation . 2 ) Without prejudice to Sub Article ( 1 ) of this Article , the powers and duties given to the Ministry of Works and Urban Development by Sub Articles ( 7 ) - ( 11 ) of Article 16 of Proclamation No. 4/1995 are hereby given to the Ministry of Federal Affairs . 12. Ministry of Agriculture The Ministry of Agriculture shall have the powers and duties given to it by Article 12 of Proclamation No. 4 / 1995 and other laws . 13. Ministry of Education The Ministry of Education shall have the powers and duties given to it by Article 21 of Proclamation No. 4 / 1995 and other laws . 14. Ministry of Health The Ministry of Health shall have the powers and duties given to it by Article 22 of Proclamation No. 4/1995 and other laws . 15. Ministry of Justice The Ministry of Justice shall have the powers and duties given to it by Article 23 of Proclamation No. 4/1995 and other laws . * * The African Law Archive 16. Ministry of Revenues The powers and duties given to the Federal Government Revenues Board by Proclamation 5/1995 and other laws are hereby given to the Ministry of Revenues . 17. Ministry of National Defence The Ministry of National Defence shall have the powers and duties given to it by Article 26 of Proclamation No.4 / 1995 and other laws . 18. Ministry of Foreign Affairs The Ministry of Foreign Affairs shall have the powers and duties given to it by Article 25 of Proclamation No.4 / 1995 and other laws . 19. Ministry of Information 1 ) The powers and duties given to the Ministry of Information and Culture by Sub Articles ( 1 ) , ( 6 ) and ( 9 ) of Article 24 of Proclamation 4/1995 and , with respect to information , by other laws are hereby given to the Ministry of Information . 2 ) Without prejudice to Sub Article ( 1 ) of this Article , the Ministry of Information shall supervise and coordinate the executive organs referred to in Article 5 ( 9 ) of this Proclamation . The Ministry of Water Resources shall have the powers and duties given to it by Article 17 of Proclamation No.4 / 1995 and other laws . 21. Ministry of Youth , Sports and Culture 1 ) The Ministry of Youth , Sports and Culture shall have the powers and duties to : ( a ) initiate policy and laws relating to the youth and upon approval , follow up their implementation . ( b ) create an environment conducive to the emer gence of a healthy and responsible youth ; ( c ) provide the necessary support to enable the youth to actively participate in the building of a democratic society based on the principles enshrined in the Constitution ; ( d ) encourage the youth to respect and promote the cultural values of the peoples of the country ; ( e ) perform , in cooperation with the concerned organs and in particular with the Regions , other activities necessary for promoting the all round development of the youth ; ( f ) supervise and coordinate the executive organs referred to in Article 5 ( 10 ) of this Proclamation . 2 ) Without prejudice to Sub Article ( 1 ) of this Article , the powers and duties given to the Sports Commis sion by Proclamation No. 12/1995 and other laws , and to the Ministry of Culture and Informaticn by Sub Articles ( 2 ) , ( 3 ) , ( 4 ) , ( 5 ) , ( 7 ) and ( 8 ) of Article 24 of Proclamation No. 4/1995 and , with respect to culture , by other laws are hereby given to the Ministry of Youth , Sports and Culture . 22. Ministry of Mines The powers and duties given , with respect to mines , to the Ministry of Mines and Energy by Article 15 of Proclamation 4/1995 and other laws are hereby given to the Ministry of Mines . 23. Ministry of Labour and Social Affairs The Ministry of Labour and Social Affairs shall have the powers and duties given to it by Article 20 of Proclamation No. 4/1995 and other laws . Other Executive Organs Neither the accountability nor the attributions of any federal executive organ not mentioned herein may be affected by this Proclamation . 25. Repeal 1 ) Article 6 and 9 of Proclamation No. 4/1995 are hereby repealed . 2 ) No law , directive or practice shall , in so far as it is inconsistent with this Proclamaiton , have force or effect with respect to situations provided for by this Proclamation . 1 ) The rights and obligations of the Ministry of Transport and Communication and the Ministry of Works and Urban Development are hereby trans ferred to the Ministry of Development Infrastructure , 2 ) The rights and obligations of the Ministry of Economic Development and Cooperation and the Ministry of Finance are hereby transferred to the Ministry of Finance and Econmic Development . 3 ) The rights and obligations of the Federal Govern ment Revenues Board are hereby transferred to the Ministry of Revenues . ” 4 ) The rights and obligations of the Ministry of Culture and Information are hereby transferred to the Minis try of Information . 5 ) The rights and obligations of the Sports Commission are hereby transferred the Ministry of Youth , Sports and Culture . 6 ) The rights and obligations of the Ministry of Mines and Energy are hereby transferred to the Ministry of Mines . 27.
